Recycling worker wins unfair dismissal case after being sacked for failing a drugs test while taking cannabis for his bad back

"A recycling worker sacked for failing a drugs test has won an unfair dismissal case after a judge accepted he was taking cannabis for his bad back.

Carl Pamment used the class B drug to tackle severe pain and help him sleep.

It helped him return to work after being off sick and did not affect his performance, the employment tribunal heard.

Nice one!
This could stop companies even bothering to test... At the end of the day the test just shows you have used weed in the last 30 days, not how often or how much unless the take hair samples

At the end of the day, if it's not affecting your work, it's no bloody business of your employer what you do out of work...

I read on something the other day it's not so much the company its kore cause of the insurance company's they deal with but I agree with fibro if it doesnt affect your work and or using it for pain or other it shouldn't be any of there dam busniess

all companies have drug policies now

last companie i worked for pulled some one for a drug test only cos the client said they see him smoking on site
Called him in and tested him and come back positive

This guy i called ganja max cos he allways stinks of weed lol told a few times bro spray some shit
you stink of weed he would laugh and walk off

Anys ways they put him on gardening leave and he then sued them for defamation of character sat at home for three months on full pay till it all ended he got 50k of them and said thamks happy daze
